Virginia Appeals Court Strikes Down Claim Against Hanover Insurance Company

The 4th U.S. Circuit Court of Appeals in Virginia recently ruled that Liberty University’s insurance provider, Hanover Insurance Company, does not have to pay for the University’s legal defense in a high-profile case.

The Hanover Case

In 2000, Lisa Miller and Janet Jenkins married in Vermont. Two years later, Miller gave birth to their daughter, Isabella. The couple separated in 2003. Miller moved to Lynchburg, Virginia, embraced evangelical Christianity, renounced homosexuality, and filed for custody of Isabella.

Miller won the custody case and later disappeared with the child. Jenkins then sued Liberty University, claiming that University employees helped Miller take Isabella out of the country. Jenkins named the former Dean of Liberty’s School of Law as an alleged accomplice.

Earlier court decisions had suggested that Hanover Insurance might cover Liberty University’s legal fees during this dispute. However, the 4th Circuit ruled that Hanover Insurance is not responsible under the Intentional and Criminal Acts Exclusion. Liberty University expressed disappointment in the ruling.
