Pregnancy Discrimination: Can I Be Fired For Having A Baby

Pregnancy Discrimination: Can an Employer Fire You for Having a Baby?

The Merced Sun-Star recently reported a troubling pregnancy discrimination case in Merced County. The report describes how an employer warned employees that they would lose their jobs if they became pregnant.

Can My Employer Fire Me for Getting Pregnant?

According to the Merced Sun-Star, an employee told her employer—an orchid grower—that she was pregnant. Soon after, the employer moved her into a different position. The next month, the employer held a staff meeting and told workers that they could not have more children. The employer also told them that anyone who became pregnant would lose their job.

After the meeting, the employer forced the pregnant employee to take leave even though she could still perform her duties. When she gave birth and asked to return to work, the employer refused to bring her back. The company continued hiring new workers during that time, which made the situation even more alarming.

The employee filed a pregnancy discrimination lawsuit. Her claim resulted in a settlement that required the employer to pay $110,000 and remove all discriminatory and retaliatory workplace policies.
