The trial court ruled in Walmart’s favor because:

  • No evidence showed Walmart or its employees placed the liquid on the floor.

  • No evidence demonstrated that Walmart employees had actual or constructive notice of the spill.

Furthermore, on appeal, the appellate court confirmed the trial court’s decision. The court emphasized that the plaintiff could not prove Walmart caused the puddle or had knowledge of its existence.

California tort law requires plaintiffs to prove both:

  1. That the store or property owner owed a legal duty to prevent their injury.

  2. That the owner either caused the hazardous condition or had actual or constructive knowledge of it.

Without proof of these elements, a plaintiff cannot succeed in a slip-and-fall lawsuit.
